Booking Terminal LLC Terms of Service for End Customers

These Terms of Service ("Terms") are entered into between Booking Terminal LLC, a limited liability company organized under the laws of the State of Delaware ("Booking Terminal LLC," "Company," "we," "our," or "us"), and the individual who uses the Booking Terminal LLC platform to complete a booking with a third-party provider or to sign an electronic waiver made available by a third-party provider through the platform ("you" or "your"). By using the Service to complete a booking or to sign a waiver, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Service Description
Booking Terminal LLC provides facilitation, payment processing, and electronic signing services that help you complete purchases and execute participant waivers with third-party providers through their websites. Booking Terminal LLC is a technology platform only. We do not provide the underlying tour, activity, rental, or other service you are purchasing, and we do not draft or author any waiver, release, or similar document presented to you for signature. Those services and documents are provided by the provider.
2. Booking and Payment
You can book services as a guest without creating an account. To complete a booking, you will need to provide personal and payment information during checkout. All payments are processed securely via Stripe, and refund/cancellation policies are determined by the provider.
3. Waivers and Electronic Signatures
This Section 3 applies if you sign an electronic waiver, release, or similar document made available through our platform.
3.1 Waiver Is a Contract Between You and the Provider
Any waiver, release, or similar document you sign through our platform is a contract between you and the provider, not between you and Booking Terminal LLC. The substantive content of the waiver — including any release of liability, assumption of risk, indemnification, photo or media release, governing law, and dispute resolution provisions — is authored by the provider. Booking Terminal LLC provides only the technology infrastructure used to display and sign the document. If you have questions about the meaning or effect of a waiver presented to you, you should contact the provider directly or consult independent legal counsel before signing.
3.2 Electronic Signature Consent
By signing a waiver electronically through our platform, you consent to the use of an electronic signature in place of a handwritten signature on paper, and you agree that your electronic signature has the same legal effect as a handwritten signature. You have the right to sign a paper copy of any waiver instead, and by proceeding electronically, you are choosing not to exercise that right at this time. After signing, you may request a paper copy of your signed waiver at no charge by contacting the provider that issued the waiver. Your consent to sign electronically will remain in effect unless you notify the issuing provider that you wish to withdraw it. Please ensure the email address you provide is current so that a copy of your signed waiver can be delivered to you.
3.3 Information You Provide
When you sign a waiver through our platform, you may be asked to provide information including your name, date of birth, email address, telephone number, postal code, and a drawn signature. You may also be asked to provide information about minor participants. You agree that all information you provide is accurate, that if you sign on behalf of a minor you represent that you are the parent or court-appointed legal guardian of that minor and have the legal authority to provide consent on the minor's behalf, and that you consent to the collection of certain technical metadata at the time of signing (including your IP address and the date and time of signature) for purposes of generating an evidentiary record of your signature.
4. Responsibilities of Users
You agree to:
- Provide accurate payment, contact, and waiver information.
- Review the provider's terms of service, waiver content, and policies before completing your booking or signing any waiver.
- Use the platform only for the purpose of completing bookings and signing legitimate waivers presented to you by providers.
5. Privacy and Data Protection
We collect the personal data necessary to process your bookings and to facilitate your electronic signing of waivers, and may share this information with the provider. We use standard security measures to protect your data. Please refer to our Privacy Policy for full details on how your data is handled.
5.1 Communication Consent
By completing a booking or signing a waiver through our Service, you consent to receiving email communication from Booking Terminal LLC related to your booking or your signed waiver, including booking confirmation, reminders, other booking-related updates, and delivery of your signed waiver.
6. Limitation of Liability
Booking Terminal LLC is not responsible for the services or experiences provided by the third-party provider. Any issues with the service you purchased should be addressed directly with the provider. Booking Terminal LLC is not a party to any waiver, release, or similar document you sign through the platform, and we are not responsible for the substantive terms or enforceability of any such document; any dispute about the meaning or effect of a waiver is between you and the provider. Booking Terminal LLC's total liability for any and all claims arising out of or relating to these Terms shall not exceed the greater of (a) the total booking fees you paid to Booking Terminal LLC in the six (6) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). In no event shall Booking Terminal LLC be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation personal injury or property damage.
7. Governing Law
These Terms are governed by the laws of the State of Georgia, USA. Any disputes will be resolved in the state or federal courts of Atlanta, Georgia.
8. Modifications to the Terms
We may update these Terms at any time. Continued use of the Service following any changes constitutes acceptance of the updated Terms.
9. Termination
We reserve the right to terminate or suspend access to our Service for any reason, including a violation of these Terms.
10. Indemnification
You agree to indemnify Booking Terminal LLC from any claims or liabilities resulting from your use of our platform, your violation of these Terms, or any false, inaccurate, or misleading information you provide in connection with a booking or waiver signature.
