1. Our Role
Our role with respect to personal information depends on the context. For information you provide to us as a provider when you create or maintain an account, we act as the controller. For information collected from end customers in connection with a booking or waiver signed through a provider's website, we generally act as the processor or service provider on behalf of the provider, and the provider is the controller for that information. End customers should contact the provider directly to exercise rights with respect to information the provider controls.
2. Information We Collect
We collect the following types of personal information from our users:
- Names
- Email addresses
- Phone numbers
- Postal codes (when collected as part of a booking or waiver flow)
- Date of birth (when collected as part of a waiver flow)
- Drawn signature images (when you sign an electronic waiver)
- Names and dates of birth of minor participants you list when signing a waiver on a minor's behalf
- Locale (derived from browser settings)
- IP address, browser type, and the date and time of waiver signature (collected automatically when you sign an electronic waiver, for fraud prevention and to maintain an evidentiary record of your signature)
- Signed waiver PDFs that we generate from the waiver content authored by the provider and the information you provide
- Any additional information that a provider chooses to collect through custom fields they configure in the waiver or booking flow. The specific information collected varies by provider and may include details relevant to the provider's activity. You should review the provider's waiver and privacy practices for information about what they collect.
3. Purpose of Data Collection
We use the collected data for various purposes:
- To facilitate and process bookings between customers and providers, including managing reservations, handling payments, and providing related functionality
- To communicate with customers about the services they are purchasing
- To facilitate the electronic signing of participant waivers and to deliver signed waiver PDFs to end customers and providers
- To maintain an evidentiary record of electronic signatures, including capturing IP address and signature timestamps for fraud prevention and audit-trail purposes
- To tailor the interface to the customer
- To comply with legal obligations and to retain records that may be needed to establish, exercise, or defend legal claims
4. Data Sharing
We share your information with third parties in the following circumstances:
- Stripe: We share data with Stripe for secure payment processing.
- Clients: We share all booking-related and waiver-related data that Booking Terminal LLC collects, including check-in details and signed waiver records, with our clients for management and operational purposes, as bookings are made through their websites.
- Other Vendors: We work with third-party vendors to operate the Service. These include Amazon Web Services (cloud infrastructure, including storage of signed waiver PDFs and email delivery), Cloudflare (content delivery and edge security), Google Analytics (website analytics), and customer support platforms. We share only the minimum amount of data required for these providers to perform their functions, and they are contractually obligated to protect your information in accordance with our standards and applicable regulations.
5. Data Retention
We retain personal information for as long as necessary to fulfill operational and legal obligations. Payment-related data is managed by Stripe, and we do not control how long they retain it. Signed waiver records (including the signed waiver PDF, signature image, signer details, and associated metadata) are retained for seven (7) years from the date of signature, after which records may be deleted, anonymized, or archived. Other customer-provided information is stored until our relationship with the client ends, as it is used for historical record-keeping, auditing, and compliance purposes. When the relationship ends, data may be securely archived, anonymized, or deleted.
6. User Rights
Users have the following rights regarding their personal information:
- Access: You can request access to your personal data.
- Correction: You can request to correct any inaccuracies in your personal data.
- Deletion: You can request the deletion of your personal data. Please note that with respect to signed waiver records specifically, your right to deletion may be limited during the seven-year retention period described in Section 5, because retention of those records is necessary to establish, exercise, or defend legal claims.

Our waiver feature allows an adult signer (typically a parent or court-appointed legal guardian) to provide certain information about minor participants — specifically, first name, last name, and date of birth — in connection with signing a waiver on the minor's behalf. This information is provided by the adult signer, not by the minor. By providing this information, the adult signer represents that they are the parent or court-appointed legal guardian of the listed minor and have the legal authority to provide consent on the minor's behalf. The provider, not Booking Terminal LLC, is responsible for determining whether its activity is appropriate for minors and for compliance with the Children's Online Privacy Protection Act (COPPA) and analogous laws.
